Arian Gardenbau provides garden design, landscaping, planting, and maintenance services. Our services include but are not limited to:

• Garden design and planning
• Landscape installation
• Plant selection and installation
• Garden maintenance
• Irrigation system installation
• Outdoor lighting

3. Consultations and Quotes

Initial consultations are provided free of charge. Quotes provided are estimates based on the information available at the time and may be subject to change based on actual site conditions, material costs, or project scope changes.

All quotes are valid for 30 days from the date of issue unless otherwise specified.

4. Payment Terms

Payment terms will be specified in individual project contracts. Generally:

• A deposit may be required before work commences
• Progress payments may be required for larger projects
• Final payment is due upon project completion
• Maintenance services are billed monthly or as agreed

5. Warranties

We provide the following warranties on our work:

• Plants: 1-year replacement guarantee when maintained according to our care instructions
• Hardscape: 5-year structural warranty on installation
• Workmanship: 2-year warranty on all labor

Warranties do not cover damage caused by extreme weather events, neglect, improper maintenance, or third-party actions.

6. Client Responsibilities

Clients are responsible for:

• Providing accurate information about their property
• Obtaining necessary permits where required
• Ensuring access to the work area
• Following care and maintenance instructions
• Notifying us of any underground utilities or hazards

7. Limitation of Liability

To the maximum extent permitted by law, Arian Gardenbau shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.

Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Arian Gardenbau and is protected by copyright and intellectual property laws.

Garden designs created by us remain our intellectual property until full payment is received, at which point they transfer to the client for their personal use only.

9. Cancellation Policy

Cancellation policies are as follows:

• Consultations may be rescheduled with 24-hour notice
• Project cancellations may be subject to fees for work already completed or materials ordered
• Maintenance service cancellations require 30-day written notice

10. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, labor disputes, or government actions.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which Arian Gardenbau operates, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms.
